Shanghai collaborates on multiple fronts to further enhance the legal-based business environment for shipping.
On February 28, as the newly revised "Arbitration Law of the People's Republic of China" (hereinafter referred to as the new "Arbitration Law") is about to officially come into effect, a series of events titled "Promoting the Implementation of the New 'Arbitration Law' and Supporting the Development of Interim Arbitration" were held at the Shanghai Maritime Court. The event aims to implement the interim arbitration system established by the new law and to help enhance the status of Shanghai as an international shipping center.
It is reported that the new "Arbitration Law" was passed by the Standing Committee of the National People's Congress on September 12, 2025, officially establishing the interim arbitration system. The outline of Shanghai's "15th Five-Year Plan" clearly proposes to "enhance the level of interim arbitration services." The Shanghai courts, adhering to the judicial concept of being "arbitration-friendly," have incorporated the support for interim arbitration and other new systems into the "Action Plan for Building a Rule-of-Law Business Environment by Shanghai Courts (2026)."
During the event, Shanghai Maritime Court and the Shanghai Arbitration Association signed the "Implementation Measures for the Coordination Mechanism of Maritime Litigation and Interim Arbitration (Trial)," establishing a new collaborative model of "court guidance, association support, and party selection." It identifies shipping insurance disputes as a pilot area for initial exploration and expands the application scenarios of interim arbitration. At the same time, the Shanghai Maritime Court issued the "Filing Guidance for Special Arbitration Judicial Cases," providing parties with clear case filing guidance. The Shanghai Shipping Insurance Association released the "Proposal to Support the Development of Maritime Interim Arbitration and Optimize Shipping Insurance Claims Services," advocating for the use of interim arbitration mechanisms in the pilot area of shipping insurance disputes and guiding the disputing parties to adopt them.
The participating parties expressed that they will take the implementation of the new "Arbitration Law" as an opportunity to further strengthen judicial and arbitration cooperation, continuously improve the mechanism for coordinating litigation and arbitration, provide parties with more diverse and efficient paths for resolving maritime disputes, and contribute to Shanghai's acceleration in building a globally leading international shipping center and an Asia-Pacific arbitration hub open to the world.
