A number of judicial work involving transportation were written into the report of the Supreme People's Court.
The judgment that forcibly taking a seat on a vehicle, squeezing, and insulting others constitutes an infringement of personal rights, clarifies that drivers who activate the auxiliary driving function after drinking should still bear criminal responsibility, reports maritime trial work to the Standing Committee of the National People's Congress, and effectively improves maritime judicial capabilities... On March 9, Zhang Jun, President of the Supreme People's Court, reported on the work to the Fourth Session of the 14th National People's Congress, with multiple judicial works related to transportation included in the report.
The report pointed out that in the past year, illegal delivery of dangerous goods, illegal transportation of edible oil by tankers, and other crimes were punished according to law to ensure the safety of people's lives, health, and property. It clarifies that drivers who activate the auxiliary driving function after drinking should still bear criminal responsibility, and the application of technology must adhere to the legal bottom line. The judgment that forcibly taking a seat on a vehicle, squeezing, and insulting others constitutes an infringement of personal rights, protects good deeds, and punishes bad acts. The "liner arrest notice" mechanism was explored, allowing the liner to continue operating after providing a guarantee when an arrest application is made, ensuring the legitimate rights of the arrest applicant while avoiding greater losses for the shipowner.
The report gave examples of two leading low-altitude economy companies involved in a series of disputes over patent rights, where one judgment could harm both parties. The court facilitated reconciliation and patent conversion by "first licensing use, then negotiating fees." In a certain area, a franchise right was set for shared electric bicycles and granted to a specific company. The court ruled that this constituted abuse of administrative power to exclude and restrict competition and ordered its revocation according to law. Guangxi courts promoted the judicial application of the "ASEAN Corpus," using rule mechanisms for "soft connectivity" to serve the construction of the new western land-sea corridor. The Shanghai Maritime Court promoted model clauses for jurisdiction agreements, with cases agreed to be under its jurisdiction increasing from 361 in 2021 to 712 in 2025; in 2025, foreign parties chose its jurisdiction in 23 cases where the disputes had no actual connection with China. After two oil tankers collided, parallel lawsuits were filed in China and another country. The Chinese court facilitated an earlier settlement and full compliance, demonstrating the fairness, professionalism, and efficiency of Chinese justice.
The report mentioned that China's judicial practice promotes innovation in international trade systems. The "Convention on Transferable Transport Documents" was reviewed and passed by the United Nations General Assembly, facilitating cross-border multimodal transport and trade financing related to China-Europe freight trains and the "Belt and Road" initiative. The first international maritime convention named after a Chinese city, the "Beijing Convention on the Judicial Sale of Ships," officially came into effect.
